These Terms & Conditions (“Terms”) govern your use of the website amgleakdetection.com (the “Website”) and the leak detection and related services provided by AMG Leak Detection (“we”, “us”, “our”). By using our Website, submitting a booking enquiry, or engaging us to carry out any work, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with them, you should not use our Website or services.

1. About Us

AMG Leak Detection is a leak detection service operating in County Donegal and surrounding areas in Ireland.

Contact details:

2. Definitions

  • “Customer”, “you”, “your” means the person or entity engaging us to carry out a Service.
  • “Service” means the leak detection, investigation, reporting and related works we agree to provide to you.
  • “Property” means the premises at which the Service is to be carried out.
  • “Quotation” or “Estimate” means the indicative price we provide before commencing work.
  • “Report” means the written report (with photos and/or videos) we provide following the Service.

3. Services We Provide

We provide non-invasive leak detection services, including but not limited to:

  • Heating leak detection (central heating, underfloor heating, boilers and stoves).
  • Hot and cold water leak detection.
  • Mains water leak detection.
  • Waste pipe leak detection.
  • Use of digital electro-acoustic equipment, thermal imaging cameras and tracer gas detection.
  • Provision of a written report, photos, videos and an invoice to support a “trace and access” insurance claim.

We may, where agreed with you, carry out limited repairs to the leak we have located. Any repair work that falls outside our usual scope (for example, major plumbing, tiling, plastering, decorating or structural repairs) is not included unless expressly agreed in writing.

4. Bookings, Quotations and Contract

When you submit our online booking form, call, email, text or message us, you are making an enquiry. A binding contract between you and us is only formed once we confirm the appointment by phone, email, text or in person.

Any prices, time estimates or descriptions provided before we have inspected the Property are indicative only. The final price and scope may differ once we have attended the Property and assessed the issue.

You confirm that the information you provide to us (including your name, contact details, address of the Property and a description of the issue) is accurate and complete, and that you are authorised to instruct us to carry out the Service at the Property. If you are not the owner of the Property, you confirm that you have the owner’s permission for us to attend and carry out the Service.

5. Pricing and Payment

Prices are confirmed on attendance at the Property or in writing. Unless we have agreed otherwise, payment is due in full on completion of the Service.

We accept payment by bank transfer, cash, or online card payment via our Stripe payment link. When paying online, your card details are processed securely by Stripe and we do not see or store your full card details.

If an invoice is not paid by its due date, we reserve the right to:

  • Charge interest on overdue amounts at the statutory rate applicable to commercial transactions or at 8% per annum above the European Central Bank main refinancing rate, whichever applies.
  • Recover all reasonable costs of collection, including legal and debt recovery fees.
  • Suspend or refuse further work until outstanding amounts are paid.

All prices are inclusive of VAT where applicable. We will issue a VAT invoice on request where we are required to do so.

6. Insurance (“Trace and Access”) Claims

The cost of leak detection is often recoverable under the “trace and access” cover in home or building insurance policies. We will, where requested, provide you with a written report, photos, videos and an itemised invoice to support your claim, and we are happy to liaise with your insurer or loss assessor.

You acknowledge that:

  • We do not guarantee that your insurer will accept your claim or pay our invoice in full.
  • You remain personally responsible for paying our invoice in full, regardless of whether your insurer pays out.
  • We are not your insurer’s agent and the contract for our Services is between you and us.

7. Your Obligations

To allow us to carry out the Service safely and effectively, you agree to:

  • Provide safe and reasonable access to the Property at the agreed appointment time.
  • Ensure that someone aged 18 or over is present at the Property during the visit (or otherwise authorised in advance).
  • Inform us in advance of any known hazards, hazardous materials (including asbestos), pets, security alarms, or vulnerable occupants.
  • Provide accurate information about the issue, the Property, and any prior repairs or alterations.
  • Move or protect any valuable, fragile or sentimental items in advance of our visit.
  • Allow us to use water, electricity and reasonable working space at the Property.

8. Cancellation, Rescheduling and No-Access

If you need to cancel or reschedule an appointment, please give us as much notice as possible. We ask for at least 24 hours’ notice where reasonably practicable.

If we attend the Property at the agreed time and we are unable to gain access, or the Property is not safe to work in, or we are turned away, we may charge a reasonable call-out fee to cover our time and travel.

We may also cancel or reschedule an appointment where circumstances beyond our reasonable control prevent us from attending (for example, illness, vehicle breakdown, severe weather, road closures or emergency works). We will give you as much notice as possible and offer the next available appointment.

9. Consumer Right to Cancel (Distance Contracts)

If you are a consumer (and not acting in the course of a business) and you have engaged us under a “distance” or “off-premises” contract within the meaning of the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, you have the right to cancel within 14 days of the day the contract is concluded, without giving any reason.

To exercise this right, please contact us by email at amgleakdetection@gmail.com or by phone at 086 236 2774, making clear your decision to cancel.

Important: if you ask us to begin the Service during the 14-day cancellation period and you then cancel, you must pay us a reasonable amount for the work carried out up to the point of cancellation. If the Service has been fully performed within the 14-day period at your express request, you will lose your right to cancel.

10. Nature of Leak Detection

Leak detection is an investigative process. While we use professional equipment and techniques and apply our best skill and judgement, we cannot guarantee that every leak can be located on every visit. Some leaks are intermittent, deeply hidden, or originate from sources outside our scope (for example, structural defects, condensation, rising damp or rainwater ingress).

Where we are unable to locate the source of a leak after reasonable investigation, we will explain our findings, suggest next steps where possible, and a fee may still be payable for the time and equipment used.

11. Property and Possible Damage

Our methods are designed to be as non-invasive as possible. However, in some cases it may be necessary, with your consent, to lift floor coverings, remove panels, or carry out other limited intrusive works in order to locate a leak. We will explain this to you and obtain your consent before doing so.

You acknowledge that:

  • Lifting tiles, laminate, carpets or other coverings may damage them and they may not be re-usable.
  • Older or fragile fittings, pipework and finishes may be more prone to damage during investigation.
  • Reinstatement (re-tiling, re-flooring, re-decoration, plastering, etc.) is not included in our Services unless expressly agreed in writing.

We will take reasonable care, but we are not responsible for damage that arises naturally from the investigation itself or from the existing condition of the Property where you have authorised the works.

12. Warranty

We warrant that we will carry out the Service with reasonable skill and care in accordance with the standards reasonably expected of a professional leak detection contractor in Ireland.

Where we have carried out a repair, we warrant that the specific repair will be free from defects in workmanship for a period of 12 months from the date of completion, provided that:

  • The defect arises from our workmanship and not from a separate fault, a different leak, third-party works, accidental damage, freezing, neglect, misuse or normal wear and tear.
  • You notify us of the defect in writing without undue delay after discovering it.
  • You give us a reasonable opportunity to inspect and remedy the defect.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2022 or other applicable Irish consumer protection legislation.

13. Limitation of Liability

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot lawfully be limited or excluded.

Subject to that, and to the maximum extent permitted by law:

  • Our total liability to you in respect of any claim arising out of or in connection with the Service or these Terms (whether in contract, tort, breach of statutory duty or otherwise) shall not exceed the total amount paid by you to us for the Service in question, or €10,000, whichever is greater.
  • We are not liable for any loss or damage that is not a foreseeable result of our breach of these Terms.
  • We are not liable for indirect or consequential losses, including loss of profit, loss of business, loss of opportunity, loss of data, or damage to goodwill.
  • We are not liable for damage caused by pre-existing defects in the Property, including (without limitation) the condition of pipework, fittings, surfaces or structures, or by issues that are unrelated to the leak we were engaged to investigate.

If you are a consumer, the above limitations apply only to the extent permitted by Irish consumer law and do not affect your non-excludable statutory rights.

14. Our Insurance

We hold appropriate public liability insurance for the Services we provide. Details of our insurance cover are available on request.

15. Reports, Photos and Intellectual Property

We retain ownership of the copyright and other intellectual property rights in any Report, photos, videos and other materials we produce.

You may use the Report, photos and videos for the purpose of making and supporting an insurance claim relating to the leak we investigated, and for your own personal records. You may not republish, sell or otherwise commercially exploit our materials without our prior written consent.

We may use anonymised photos, videos and case study information for our marketing, training and educational purposes. We will not include your name, address or other identifying personal data without your consent.

16. Use of the Website

The content of our Website is provided for general information only. While we make reasonable efforts to keep the Website up to date, we do not warrant that the content is accurate, complete or current at all times.

You agree not to:

  • Use the Website in any unlawful, fraudulent or harmful way.
  • Attempt to gain unauthorised access to the Website, its servers, or any related systems.
  • Introduce viruses, malware or other harmful code.
  • Copy, reproduce or republish any part of the Website (other than for your own personal, non-commercial use) without our prior written consent.

All trademarks, logos, text, graphics and images on the Website are the property of AMG Leak Detection or our licensors and are protected by intellectual property laws.

17. Reviews and Testimonials

Reviews and testimonials displayed on the Website are genuine and provided by our customers. We may use Google or other third-party review platforms to display reviews. We do not edit reviews other than to remove personal data or content that is unlawful or in breach of platform rules.

18. Privacy

Our use of your personal data is governed by our Privacy Policy, which is available on our Website. Please read it carefully to understand how we collect, use and protect your personal data in accordance with the GDPR and the Irish Data Protection Act 2018.

19. Events Outside Our Control (Force Majeure)

We are not liable for any failure or delay in performing our obligations where that failure or delay results from any cause beyond our reasonable control, including (without limitation) severe weather, flood, fire, illness, pandemic, industrial action, supply chain disruption, road closures, or acts of any government or authority.

20. Complaints

We aim to provide a high quality service. If you have any concerns about the Service, please contact us as soon as possible at amgleakdetection@gmail.com or 086 236 2774. We will acknowledge your complaint promptly and aim to resolve it fairly and quickly.

Consumers in Ireland may also be entitled to refer disputes to the Competition and Consumer Protection Commission (CCPC) or to use the EU Online Dispute Resolution platform.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, legal requirements or other factors. The “Last updated” date at the top shows when they were last revised. The Terms in force at the time you book a Service will apply to that booking.

22. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) are governed by the laws of Ireland.

You and we agree that the courts of Ireland have exclusive jurisdiction to settle any such dispute or claim, except that, if you are a consumer resident in another EU member state, you may also bring proceedings in the courts of the country in which you are resident.

23. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any written quotation or order confirmation, constitute the entire agreement between you and us in relation to the Service and supersede any prior agreements, representations or understandings.
